This is a question which requires some fiqh knowledge. I just want to discuss the fiqh of it, so would prefer, if personal biases are set aside in answering the question. My question is, would it be a correct understanding, Islamically, that when the ruling of a matter is “permissible” in the shariah rather than “Mustahhab” or “Sunnah” one can weigh the pros or cons of that matter and make own personal decision on whether to practice it or not? I ask this specifically in the context of polygamy. If one can think to potential harms polygamy might cause - such as pain to the wife/woman and possibly statistics that point to harms would it be correct to advice against polygamy weighing its pros and cons? For eg drinking energy drinks is permissible but it’s not good for you - so you may discourage it. Just like that would it be islamically fine to discourage polygamy? Would it be different in the case of polygamy because polygamy is explicitly mentioned in the Qur’an? What is in my mind as I think about this issue is verse 1 of Surah tahrim. By the way, for the benefit of this discussion, I am referring to the opinion of those scholars who consider polygamy only permissible and not Sunnah. I understand there are other opinions but that is not what this discussion is about. Like I said I am interested in the fiqh so I would appreciate someone wijt some knowledge of fiqh and for personal biases to be set aside.

I know the quran mentions iddah for ones who have not menstruated but i assumed its still talking about someone with physical capacity or at least close to puberty. I know that physical capacity is what permits intercourse according to islamic law but what about acts short of intercourse isnt capacity still important. I have seen another passage of istibra being discussed again for girls 6-7,there is no awrah for children until 7 years because they are not even perceived that way, were scholars permitting this at any age even infancy? Was phycological harm not considered for concubines? 2. The Case of Young Girls Regarding a young girl who is too young for intercourse: Is istibra mandatory for her? There are two scholarly views (wajhan): The First View (Mandatory): It is obligatory. This is the apparent meaning of the Imam’s (Ahmad bin Hanbal) words in most narrations. He stated that she must undergo istibra even if she is "in the cradle," and physical contact with her is forbidden just as it is with an adult woman. Assalam alaykoum. Or is it that we should only rely on quran and sunnah for our life decisions and not take on consideration life coïncidances as signs and something to act upon. In this case, can the owner of the stolen goods reward the brother who helped him, with a portion of that stolen goods as a token of thanks? After 2 months of no contact we started communicating and had intercourse after her visiting me. In the visit i could see that she still loved me and was still inlove with me as we discussed the reasons she left me. On another occasion due to the passing of a close friend I collected her and attended his funeral. Thereafter we had intercourse again, but with intention to reconcile. I have arranged 2 witnesses to draw up a document to revoke the talaq and take her back as myself and my wife agreed to reconcilation and I would rather take her back in all ways possible as I am afraid her family would try and find ways to keep us apart. **Is intercourse a way of taking her back?** Once I have taken her back with witnesses can her parents keep her away from me? She will not be present but she is aware of me revoking the talaaq, is that permissible? Shukraan in advance for your assistance.

The cultivator has no legal share in the records; there is only a local tradition that our ancestors used to farm this land long ago, but it hasn’t been cultivated by us for the last fifty years. I also heard a narration saying that in Islam, if the owner does not cultivate the land for three years, it can be taken back from him. So from a religious perspective, what is the ruling? According to the law, we have the right to take back the land — but according to Islam, should we give it up?

He replied: Drum. Abu Dawood 3696: Book 26, Hadith 3687 *side note, (الدُّبَّاءِ) *dubba'e* is not a pumpkin per-se but more precisely calabash or long melon because pumpkins were not discovered until Columbus in the 15th century. A bit of an anachronism since the hadith takes place 1,400 years ago.
