Hi everyone this is going to be a long read to please bear with me I try to make it as short as possible. I am a muslim girl from a household of 7 siblings my dad has 2 wifes my mom and then I have a step-mother and 2 step-siblings. My mom is British so I have always enjoyed the British culture and have been in the UK for nearly 10 years but before my dad worked in Saudi Arabia, and that's where it all started. My own brother sexually abused me for a duration of 5/6 years it started when I was 7. He use to buy me things like phones, take me out and buy cloths etc and do stuff to me in exchange, he never went in but always tried to put stuff etc in my behind and forced me to watch inappropriate content. I never liked it, I never wanted it but I was young and my family was never close, my mom and dad didnt really care about me or tought me anything or the whole family, no one is close, no one cares about each other. I had no support to tell anyone and never felt safe. It came out last year and no one believed me, not even my mom which is what hurts the most. I want her to not speak to him, or forgive him, or call or have any association with my brother because of what he did to me. My mom is old and doesnt know half the time what day it is. I tried to forgive her because after my sisters visted me and I told the full story they believed me but I didnt want to have to say it all for someone to believe me. They convinced my mom but its not genuine why didnt she believe me when I told her. My dad also found out but didnt call me, or didnt call my husband (who already knew), didn't message or visit me which also makes me so angry. My mom says she believes me but I dont actually think she does, when I visit her its so fake she thinks it's all gone away but doesn't want to talk about the actual subject, my brother, who abused me, used to live with us at my mom's house and I hate visiting because it triggers me. I went a while ago and when I left i cried my eyes out to my husband, i am just to angry and hate the house and my mom why didnt she believe me why is she still talking to him I just dont know what to do. Best case scenario I want her to talk to me about it and tell me she believes me and I want her to cut ties with that monster. But I know she wont do that as 'it her son' but I just dont know how to handle this. My husband has been through this with me and if it wasnt for his support, I dont know what i would be doing. He is very understanding, this issue has effected our relationship and it hard at the moment. Any advice would be really appreciated.

In modern law, marital rape is on par with extramarital rape in terms of legal consequences: the rapist will be punished, whether the victim was his spouse or not. This is not clear to me in sharia if the husband rapes the wife. One of her major duties according to the marital contract is sexual availability, and refusing to oblige is not only considered a major sin, it has the legal implication of [losing her right to maintenance by her husband](https://islam.stackexchange.com/a/38759/17702) (the linked answer talks about leaving the house without permission, but on a fortiori grounds, this also holds about her refusing intercourse; this result is also explicitly mentioned in the section of which excerpts are cited in the linked answer). I can't find a definition of rape in fiqh sources, and the only mention of a punishment for rape in Reliance of the Traveler I can find is in o7.3 in the context of how far self-defense can go (not in the context of legal punishments): > As for when an aggressor is raping someone whom it is unlawful for him > to have sexual intercourse with, it is permissible to kill him > forthwith. Clearly this says nothing about marital rape since it is lawful for the husband to have sex with his wife. (To explain the difference: is a husband who rapes his wife by beating her with an iron rod punished differently from a husband who beats his wife with an iron rod without also raping her?)

I was looking at Sunan Abi Dawud 4379. The Hadith is graded as Hasan, but according to Al-bani it only qualifies as Hasan if you remove any mention of stoning from the Hadith. But there is another version of the same hadith that is graded as Hasan even with the inclusion of stoning [Jami at-Tirmidhi 1454]. Salamualaikum. Let me first clear the air by saying I'm in no way shape or form supporting rape, but all I want is clarification. My question is if an inappropriately dressed woman goes out late in the night for no reasonable purpose and gets raped, doesn't she share a part of the blame, however small, for tempting the rapist? Remember, not only did she dress inappropriately, she also went out late in the night for no good reason. This question is as a result of the fact that many women even Muslim women want to hide under the cover of "**the victim is never at fault**" and dress inappropriately. I'm not even in support of this mantra because in **some cases** I believe the victim takes a part of the blame. I know Islam doesn't support rape but it also frowns at indecent dressing from both men and women!

If a woman admits to being raped, and the rape cannot be proven by the legal system, the man or men walks free. If a woman tells she was raped and is not able to prove it, does it mean she engaged in pre-martial sex and will be punished for it? I have been trying to understand why people in the West who are Muslim say that it's rape no matter if penetration has occurred or not. All other scholars I'm aware of classify rape as *zina bil jabr*, literally "forced illegal intercourse". This is relevant from two perspectives: - the burden of proof for hirabah may be different than for zina (all scholars I'm aware of require the burden of proof for zina in rape cases, which is four witnesses or a confession; in contrast, at least Saudi Arabia is claimed to have a burden of proof of [two witnesses or a confession](https://en.wikipedia.org/wiki/Hirabah#In_modern_legal_systems) for hirabah) - the punishment for hirabah is different from the punishment for zina and coercion I've seen the nuance mentioned that it matters whether the rapist used a weapon or not. I was very upset as I don't want to do this kind of act. Still I'm talking to him but not in any sexual relationship between us now. Please tell me the solution. I cant sleep in nights and this sin is making me upset. I don't want to do this but he raped me. God knows what was his intentions, but I don't want to keep such relationships.
