From this question https://islam.stackexchange.com/q/4205/17163 , the OP writes: > **It is agreed upon that piracy is theft** according to the question Where does Islam stand on Internet Piracy? I'm respectfully contesting this claim in this question in the context of fiqh. **Question**: Is piracy a form of theft for the purposes of fiqh? In anticipation of answers which don't carefully read the question, *I'm not contesting whether or not piracy is halal/haram*; I'm contesting whether or not it's classed as theft (which may result in hadd punishment ) or something else (not necessarily requiring hadd punishment). The answers to the question Where does Islam stand on Internet Piracy? are all of the form "someone on the Internet said so" (specifically, "...this becomes copyright infringement, or stealing", "...it is still considered stealing" and "...you are not stealing anything"). Consequently, **I'm looking for authoritative sources**, e.g., fatawa. (Please back up responses and refrain from adding yet another "someone on the Internet said so" answer.) ---- Online fatawa generally seem to refrain from calling it theft. Here's what I've found via Google: - Islam Q&A 81614 quotes from fiqh councils; they declare it impermissible, but do not declare it theft. Indeed, they even go so far as to write: > Some of our scholars think that it is haraam to do this (copy things) for the purpose of selling them, but if a person makes a copy just for himself, that is permissible. In other words, "some of our scholars" argue that it's halal for personal use, and therefore is not considered theft (which is haram). - IslamWeb 132937 , 305998 , 326746 , 327097 also refrain from describing it as theft, instead using the far more tempered description "...the opinion adopted at Islamweb is that copyright ... are recognized and protected by the sharee'ah". - AskImam 949 , 25083 likewise refrains from calling it theft, with 949 even quoting Mufti Taqi Uthmani 's description of the attitudes of a "group of contemporary scholars": > ...there is no precedent in the Holy Qur'an, in the Sunnah or in the juristic views of the earlier Muslim jurists where an intangible object has been subjected to private ownership or to sale and purchase. They further argue that 'knowledge' in Islam is not the a property of an individual, nor can he prevent others form acquiring knowledge, whereas the concept of 'intellectual property' leads to the monopoly of some individuals' knowledge, which can never be accepted by Islam. - IslamQA.org: DarulUloomTT.org , AskImam 15940 , AskImam 19162 also refrain from calling it theft. Moreover, another fatwa listed on IslamQA.org writes: > In our understanding, copyrighting (attaching the clause of copyright) in itself is an act of oppression and injustice. -- Muftionline.co.za I found a single terse fatwa on IslamQA Darulifta-Deoband.org which described it as theft: > ...a lot of piracy takes place and piracy is a kind of theft and it is considered illegal but still it takes [place]... Is it allowed or not in Islamic view? > ... > Theft is not allowed in these matters also. The following searches returned no hits: site:askamufti.com piracy, site:fatwa-online.com piracy, site:sunnipath.com piracy. **Keep in mind that my search was limited to English-language fatawa.** ---- This question is related to: - https://islam.stackexchange.com/q/29576/17163 and https://islam.stackexchange.com/q/16670/17163 , which asks about justifications for software piracy, - https://islam.stackexchange.com/q/20219/17163 , which asks how bad software piracy is (which didn't get answered quantitatively); this question here is more specific, - https://islam.stackexchange.com/q/18762/17163 , https://islam.stackexchange.com/q/23611/17163 , https://islam.stackexchange.com/q/34761/17163 , which ask in the context of books - https://islam.stackexchange.com/q/13168/17163 I found several other answers on Islam.SE which again take the form of "someone on the Internet said so": - https://islam.stackexchange.com/q/11772/17163 , where one of the answers described software piracy as "basically stealing" and another said "piracy is theft". - Regarding https://islam.stackexchange.com/q/600/17163 , the top answers write "Piracy is stealing, plain and simple" and "Obviously, piracy is stealing by definition". - The answer to https://islam.stackexchange.com/q/4205/17163 writes "this kind of theft is not like normal theft". (And a recent Islam.SE user comment indicated surprise at my attitude that "piracy" is a crime distinct from "theft".)

In the Rule of Law section of this Wikipedia article , the following is asserted: > Various Islamic lawyers do, however, place multiple conditions, and stipulations—e.g., the poor cannot be penalised for stealing out of poverty—before executing such a law, making it very difficult to reach such a stage. It is well known that, during a time of drought during the Rashidun caliphate, capital punishments were suspended until the effects of the drought passed. Is this a mainstream Islamic position? Which Islamic countries practiced this and when?

Will the hand of a Jew be cut for stealing?
Islam has a law whereby a thief's hand is amputated, however Judaism does not proclaim such a punishment (Exodus 22). What would happen to a Jewish thief under Shariah law? Would his hand be amputated? Or would he be punished pursuant to the teachings of his own religion?

Lately, the government in UK has been lending out money to help business in crisis due to COVID-19 which when approved have one year to return without interest. It has created a perfect opportunity for people to get money even by mean of creating a fictitious business or creating an illusion of business hit by COVID-19. Some people argue that they are using the money for betterment as to invest in places where they feel it is needed the most e.g helping out siblings. Is it money gotten by the above-mentioned means Halal or Haram to use? some might argue that Allah has created opportunities to help us so why not help to make things better? IMO I feel it is haram because it is sort of forgery or making other (in this case bank fool).

Hei. Me and my sister bought a house together. We paid 100 000 each the rest was a loan we took together. We fixed the house so we both worked there by painting and on. The same day we was finished she locked me out of the house. I couldt go in. So she went to a lawer and made papers so that i can sign the house over to her. I refused. But i wanted to get a deal so i signed the papers but i wasent gonna give them to her until we make a deal. I trusted my mother and gave my mother the papers. I told my mother not to give them to her beacuse then she will take thd house. My mother said ok but she gave them to my sister and my mother says that she stole them from her. I made her call her and demand the papers back my sister said no. She gave me my 100000 minus a loan we took to fix the kitchen. I then realized that i lost house i stole some gold from her i sold it for 23000 she lived in the house for about ten years and sold it with a profit about 2 millions. Now 14 years later i give her the money for the gold but she refuse to take it beacuse she wants to be forgiven first. I dont want to forgive her unless she gives me my half of the profit. What do i do? Can she refuse to take the money when i try to make opp for my wrong?do i have to forgive her. She wants forgivness but dont want to give anything back.what does islam say about this. I want to pay back. She lived and paid for the house i paid for rent other place so in my opinion the house was mine also the hole time cuse i never agreed to give it to her. She stole it.

Assalamulaikum, I stole a piece of stationery from a girl in my class when I was young (after puberty though), I have repented for my thievery, and regret it every time I remember, but I read the hadith that even deeds like jihad and martyrdom only expiates your rights to Allah swt, and not to the people, so a man who died as a martyr still went Hell because he stole a cloak from a war booty. (Muslim 1886) I am very scared because I no longer have the stolen items and don't know how to give back to the people I took things from. I think as a child I suffered from kleptomania after reading about it, but It was never diagnosed so I cant be sure. Jzk

It's written in their site that they don't host any videos and their videos are uploaded by users. So that video may be copyright but site claims no ownership of that videos. Similarly some pirated videos are also uploaded on YouTube by some users. ´ Are we allowed to watch them? Would we be stealing if we are streaming such videos? I'm not talking about downloading, copying or distributing but is only streaming also not allowed?

Now I know that selling illicit substances or stealing or pickpocketing it's haram by default according to Quran, Sunnah and ijmaa', so I don't want answers like "Stealing is haram and deplorable..." because I'm going to mention a very delicate context. If a person 1- is homeless, cannot get a job because they have had a bad past and, because of it, they are barred from both job centers and job market itself, 2- cannot go out of their own country because they're the citizen of that only country and they are moreover barred to go out of that country (i.e passport revoked permanently) 3- won't be helped by social services because of, again, their bad past. 4-has not any relative whatsoever 5-tries to seek help but with no avail because of them being rejected for the person they were and their only way to survive is to pickpocket, steal items or growing and selling illicit substances, is it islamically permissible for them to seek these routes, since all the possible legit doors are shut down for them? P.S these things are haram in general, I do know that.

If someone is found to be guilty of theft, there applies Islamic law concerning theft; that is, the hand should be cut off from the wrist joint. > “[As for] the thief, the male and the female, amputate their hands in > recompense for what they earned [i.e. committed] as a deterrent > [punishment] from Allah. And Allah is Exalted in Might and Wise.” > [Quran 5:38] Now my questions are, - Does this apply to all cases of theft, or are there certain preconditions? - Which are the countries where this law is applicable? - Is there any record of how many people got this punishment? (country wise where this rule applies)
